By accessing or using the We Are Small platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is a browser-based 3D Solar System explorer available at wearesmall.cloud.
If you do not agree to these Terms, you may not access or use the Service. We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after such notification constitutes acceptance of the modified Terms.

We Are Small is a free, browser-based 3D Solar System explorer built with Three.js and WebGL that provides:

3. Account Registration & Security
3.1 Account Creation
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Promptly notify us of any unauthorized access or security breaches
- Accept responsibility for all activities under your account
4. Purchase & Payment
4.1 Free and Premium Tiers
The Service offers a free tier that provides access to the core 3D Solar System explorer, including planets, moons, and basic navigation. A premium tier is available as a one-time lifetime purchase of $9.99 (USD) that unlocks additional content including extended Solar System objects (Kuiper Belt, dwarf planets, comets), spacecraft and missions, educational guided tours, and interactive science modes.
4.2 Payment Terms
The premium upgrade is a one-time payment processed securely through Stripe. As a digital product delivered immediately upon purchase, all sales are final and non-refundable except as required by applicable law. We reserve the right to modify pricing for future purchases, but your lifetime access will not be affected once purchased.
5. Acceptable Use
5.1 Permitted Use
You may use the Service for personal, educational, and non-commercial purposes in accordance with these Terms.
5.2 Prohibited Conduct
You agree not to:

- ✕Upload malicious code, viruses, or content that could harm the Service

You retain all ownership rights to your account data and any settings or preferences you configure within the Service ("Your Data").
6.2 License Grant
You grant us a limited, non-exclusive license to host, store, and process Your Data solely for the purpose of providing the Service to you. This license terminates when you delete Your Data or close your account.
6.3 Data Backup
While we maintain regular backups, you are responsible for maintaining your own records of any important information associated with your account.
7. Intellectual Property
7.1 Our Intellectual Property
The Service, including its software, 3D models, textures, visual design, educational content, and documentation, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand features. NASA-derived textures are used in accordance with NASA's media usage guidelines.
7.2 Feedback
If you provide feedback, suggestions, or ideas about the Service, we may use them without obligation to compensate you. Such feedback becomes our property.
8. Third-Party Services
The Service integrates with third-party services to provide core functionality. Specifically, we use Stripe for payment processing and Supabase for authentication and data storage. Your use of these integrations is subject to their respective terms and privacy policies. We are not responsible for third-party services' availability, security, or content.
9. Service Availability & Support
9.1 Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable notice. Unscheduled maintenance may occur in emergencies.
9.2 Support
Support is available via email at hello@wearesmall.cloud. We aim to respond to inquiries within a reasonable timeframe but do not guarantee specific response times.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- • Indirect, incidental, special, or consequential damages
- • Loss of profits, revenue, data, or business opportunities
- • Damages exceeding the fees paid by you in the 12 months preceding the claim
- • Any downtime, errors, or service interruptions
These limitations apply regardless of the theory of liability (contract, tort, or otherwise) and even if we have been advised of the possibility of such damages.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be error-free, secure, or available at all times. Educational content is provided for informational purposes and should not replace professional scientific or academic sources.
12. Indemnification
You agree to indemnify, defend, and hold harmless our company, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

These Terms are governed by the laws of the jurisdiction where our company is incorporated, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of that jurisdiction, at our discretion.

Severability
If any provision is found unenforceable, the remaining provisions will continue in effect.
Waiver
Our failure to enforce any right or provision does not constitute a waiver of that right.
